NOTICE OF FINANCIAL INCENTIVE


From time to time, Direct Marketing Ventures, LLC or its affiliates (hereinafter “Samsonite”) may offer customers financial incentives, such as the opportunity to receive discounts and coupons and/or participate in promotions, contests, sweepstakes and other special offers (“Promotions”). 

 

Participation in Promotions offered by Samsonite is optional and requires a customer’s prior opt-in. Opt-in may vary by Promotion, but generally involves submitting information, including personal information, through a pop-up describing the Promotion. Samsonite offers Promotions when, for example, a customer shares their name and email address in order to enter into a sweepstakes or contest to win merchandise and/or to receive a one-time percentage-off coupon. Collecting customers’ personal information (including name and email address) and other personal information as described in Samsonite’s Privacy Policy allows Samsonite to offer Promotions to customers.

 

Samsonite uses personal information for marketing and other purposes described in Samsonite’s Privacy Policy. For example, Samsonite may use personal information to send customers emails, newsletters, or other similar communications that may be of interest to customers. Samsonite also (a) “sells,” as the term is defined under the California Consumer Privacy Act and the Colorado Privacy Act, and (b) uses for targeted advertising or “shares,” as the term is defined under the California Consumer Privacy Act, the personal information of customers (including both customers who participate in Promotions and those who do not), as described in Samsonite’s Privacy Policy . The following details are disclosed in Samsonite’s Privacy Policy:

 

  • Categories of personal information sold to third parties;
  • Categories of personal information, including sensitive personal information (where applicable), processed for purposes of targeted advertising; and
  • Categories of third parties that will receive customers’ personal information, including sensitive personal information (where applicable).

 

The amount of personal information that Samsonite collects from a customer may vary and depends on the type of Promotion the customer chooses to participate in. The types of personal information that Samsonite collects from customers who participate in Promotions are generally similar to the types of personal information that Samsonite collects from customers who do not participate in Promotions.



The value of customer personal information obtained through Promotions by Samsonite arises from: Samsonite’s increased customer interactions and brand engagement; the costs and expenses Samsonite incurs in offering Promotions to customers; the types of Promotions provided; and the collection, use, and retention of the personal information of customers who have voluntarily provided such information and chosen to participate in Promotions. The value of Promotions to customers varies significantly as individual customers may take advantage of the Promotions to varying degrees.



Customers who are California or Colorado residents may exercise their privacy rights, including the rights to know and correct, without any effect on their eligibility to participate in Promotions. However, if a customer chooses to exercise their deletion or opt-out rights, then Samsonite may not be able to continue to provide the customer with those Promotions that are offered through email or other communications channels for which Samsonite no longer has that customer’s relevant contact information.



A customer’s opt-in consent to a Promotion may be revoked at any time. Customers may revoke their consent and opt out of a Promotion at any time by notifying Samsonite at 1-800-223-7267, or by submitting an online form. Customers may also write to us at:

If a customer opts out, Samsonite will not reduce the value of any previously received Promotions or other financial incentives.
